Florida Bill Proposes Treating Accusations Of Discrimination As ‘Defamation

A proposed bill in Florida, introduced by state Senator Jason Brodeur, aims to categorize accusations of racism, sexism, homophobia, or transphobia as defamation, reports The New Republic. This potential legislation could significantly impact freedom of speech in the state by making it easier for individuals to sue others for defamation, particularly in cases involving discrimination claims.

The measure states that “an allegation that the plaintiff has discriminated against another person or group because of their race, sex, sexual orientation, or gender identity constitutes defamation per se.”

The bill suggests conditions for automatically inferring “actual malice” after an accusation of discrimination, potentially simplifying the process of proving defamation.

However, legal experts suggest that if the bill becomes law, it is likely to face legal challenges for violating free speech and anti-discrimination laws.
